The Digital Paradox: How Copyright Laws Keep E-Books Locked Up

E-books are great. As long as you buy them. Borrowing is more difficult.
E-books are great. As long as you buy them. Borrowing is more difficult.

Many publishing houses don't allow their products to be lent out by digital libraries for fear of piracy. Articles and books by researchers are also affected. Readers are the ones who have to pay the price.

When the German author Johann Gottfried Seume took his famous "Stroll to Syracuse," as he entitled his book about his nine-month walk to Sicily in 1802, he made sure to visit a number of local libraries along the way. At the time, it was often impossible to check out books. If you wanted to read them, you had to be mobile.

Today, the situation has come full circle. If a student in Freiburg wants to read the hard-copy version of a book from the university library in Basel, he or she can simply order it via an interlibrary loan. But if only an electronic version is available, interlibrary loans are generally not an option. The student has no choice but to climb into a train and head to Switzerland to read the book on a university computer.

It is a paradox: Books that traveled around the world via interlibrary loan in the 20th century paper era are safeguarded locally in the Internet age. Indeed, it is the sheer ease with which electronic publications can be sent around the world that is now resulting in their being locked up behind digital bars. The book doesn't go to the reader, the reader comes to the book -- just like in the 19th century.
Interlibrary loans were formalized in Prussia in 1893 with the "edict pertaining to lending." But it doesn't apply to the new electronic world. Today, publishing houses dictate their conditions to libraries, motivated by their justifiable fear of pirated copies. Unfortunately, it is honest readers who have to pay the price.
Many publishing houses don't issue licenses for loaning out e-books: Influential German publishers such as Droemer Knaur, Kiepenheuer & Witsch, S. Fischer and Rowohlt, for example, are nowhere to be found on the German-language online lending library Onleihe. That means that important works such as the new definitive World War I study by Berlin-based political scientist Herfried Münkler cannot be checked out electronically. It is a situation that would be unimaginable in the world of paper.
'Delightful Absurdities'
Indeed, many electronic books only exist on closed platforms such as Apple's iBooks or Amazon's Kindle. And protection software used by many publishers make access to their products even more difficult. Adobe, whose system provides the foundation for the majority of all e-books, is currently revising its software. Many older readers may no longer be able to display newer e-books as a result.
The issue isn't just the latest crime novel bestseller. The issue is the core of the knowledge economy: essays, articles and books from researchers. "We have thousands of e-books that we could make available to our users via the Internet," says Harald Müller, head librarian at the Max Planck Institute for Comparative Public Law and International Law in Heidelberg. "Be we often aren't allowed to because licenses are so restrictive."
Copyright laws often lead to "delightful absurdities," says Müller. If, for example, he wants to read an essay from an American library via interlibrary loan, "they will print it out on paper and send it over by fax -- and I will then scan it into our computers here." Sending it as an email attachement is forbidden.
It is, of course, legitimate for publishing houses to try to defend themselves from copyright violations. But for the moment, the strategies they employ almost exclusively inconvenience well-meaning readers. Library users, for example, often are "not allowed to print out e-books or to save them on USB sticks," says Oliver Hinte, head of the legal commission at the Association of German Libraries. But what is one supposed to do instead? Copy out passages by hand?
"Appropriate technical solutions to prevent piracy have been around for a long time," says Gerald Schleiwies of the city library system in Salzgitter near Hanover. "Digital watermarks allow documents to be personified. My name is prominently displayed on every page and can't be as easily removed as so-called copy protection."
Schleiwies is currently writing his Ph.D. thesis and travels across Germany for his research. He has five separate library cards. "The scanning and mailing of excerpts is no longer allowed," he says.
The Specter of Copyright
There are plenty of absurd examples. Franco Moretti, for example, an English professor at Stanford University, achieved renown with his study "Atlas of the European Novel." But his research ends at the point when rigid copyright laws, which protect works for up to 70 years after the death of the author, present a roadblock. It is dangerous to scan more current works of literature, Moretti says. "The specter of copyright keeps (them) too protected for us to make inroads. Too bad!"
"Currently, copyright owners are often in a unique position of power," says Hinte. "A reform and simplification of copyright laws is long overdue."
In many cases, it is the readers themselves who, through their taxes, pay the university authors whose studies they are then unable to access. It is also likely that many professors themselves cannot even afford a subscription to the journal in which their work is published. Subscription rates of up to €15,000 ($20,633) per year are hardly a rarity. The Journal of Comparative Neurology, for example, comes with a price tag of more than €20,000 annually. Authors who publish their works in such a journal usually don't see a single cent for their labors. Publishing companies such as Reed Elsevier, by contrast, regularly achieve pre-tax profit margins of over 25 percent.
"Publishers of scientific journals make so much money because they collect their product for free from taxpayers and then sell it back at inflated prices," says Günter M. Ziegler, a distinguished mathematician at Berlin's Free University.
Until two years ago, Ziegler was the co-publisher of two mathematics journals at Reed Elsevier. Then he joined a boycott that has since attracted the support of 14,000 others. He is now working for an academic journal that is available to everyone on the Internet according to open access principles. Elsevier says that the conflict has more to do with a misunderstanding than a conflict of interests.
Back to the Future
Initial compromises have been made. In January, institutions such as the Geneva-based CERN nuclear research center began paying Elsevier a flat fee for the publication of physics journals which are then made available free of charge.
Adjustments to copyright law are often tiny, but effective. That is the case with older works whose authors can no longer be determined. Heretofore, for example, old, yellowing newspapers couldn't be digitized until all of the writers involved were contacted. Works of cultural value were being sacrificed at the altar of copyright. As of the beginning of this year, new rules pertaining to limitations and exceptions to copyright now make it easier to scan orphaned works.

The mini-change could also make it possible for researchers to post their work on the Internet -- but only one year after they are published in an academic journal. The first are expected to do so in 2015.
Until then, though, people in search of specific articles or publications will be forced to chase down the artificially limited supply of e-books for the privilege of reading them on library monitors and taking notes by hand, much as monks used to do. Or like the man of letters Seume during his journey to Syracuse over 200 years ago. Back to the future.

Google Books ruled legal in massive win for fair use

Scans that show snippets are legal—they don't replace the full book.

A long-running copyright lawsuit between the Authors' Guild and Google over its book-scanning project is over, and Google has won on the grounds that its scanning is "fair use."
In other words, the snippets of books that Google shows for free don't break copyright, and Google doesn't need the authors' permission to engage in the scanning and display of short bits of books.
The ruling (PDF) was published this morning by US District Judge Denny Chin, who has overseen the case since it was filed in 2005.
The parties tried to settle this case, but the judge rejected the settlement as unwieldy and unfair. Now, the case has instead resulted in a hugely significant fair use win, opening the door to other large-scale scanning projects in the future.
Along with the First Sale doctrine, fair use is the most important limitation on copyright. It allows parts of works to be used without permission of the copyright owner to produce new things: quotes of books used in reviews or articles for instance.
Legal disputes over what or what is not "fair use" are often complex, and there are four factors that judges consider. But the one that's often the most important is what kind of effect the fair use will have on the market for the original product.
Judge Chin seemed to find the plaintiffs' ideas ignorant, if not nonsensical, in this regard. He wrote:
[P]laintiffs argue that Google Books will negatively impact the market for books and that Google's scans will serve as a "market replacement" for books. [The complaint] also argues that users could put in multiple searches, varying slightly the search terms, to access an entire book.
Neither suggestion makes sense. Google does not sell its scans, and the scans do not replace the books. While partner libraries have the ability to download a scan of a book from their collections, they owned the books already—they provided the original book to Google to scan. Nor is it likely that someone would take the time and energy to input countless searches to try and get enough snippets to comprise an entire book.

Seeing the project as a boon to researchers

Before Chin gets into the deep legal analysis, he begins with a section noting the many benefits of Google books. The giant book-scanning project has already become an "important tool for researchers and librarians," noted Chin. Through data mining, researchers can do things they've never been able to do before, examining "word frequencies, syntactic patterns, and thematic markers to consider how literary style has changed over time."
The program expands access to books, particularly to "traditionally underserved populations," he notes. The books Google scans provide the potential for them to be read in larger text formats or with Braille or text-to-speech software. And the project could save old out-of-print books that are literally falling apart in library stacks.
Chin runs through the four traditional factors that decide whether use of a copyrighted work is "fair use."
First, he found Google's use of the works was highly transformative. "Google Books digitizes books and transforms expressive text into a comprehensive word index," he wrote. There's already legal precedent allowing large-scale scanning in order to create indexes and search services—created, in part, by Google. Chin cited the Perfect 10 v. Amazon case, which ruled the scanning of images and publication of "thumbnails" in Google image search is legal.
He also found that Google Books "does not supersede or supplant books because it is not a tool to be used to read books." The service adds value to books.
Chin notes that Google is a commercial service, which weighs against a finding of fair use. But while the service may draw more people to Google websites, Google isn't engaged in "direct commercialization" of the copyrighted works. The company "does not sell the scans it has made of books for Google Books; it does not sell the snippets that it displays; and it does not run ads on the About the Book pages that contain snippets."
Another factor is the amount of the work used. Google is scanning full books. But "copying the entirety of a work is sometimes necessary to make a fair use of the image," wrote Chin, citing a case involving the use of reduced-sized Grateful Dead posters called Bill Graham Archives v. Dorling Kindersley.
Important, of course, is the fact that Google is showing limited amounts of text to book searchers. Blacked-out sections and other technical measures prevent full-book copying.
In the end, the full-book scanning weighed only "slightly against" a finding of fair use. It was overridden by the other factors. Especially important was Chin's view, discussed above, that Google Books would not hurt, and may in fact help, the market for the original books.

A nearly-settled case will now be fought on appeal

The parties tried to settle this case but were unable to. A proposed settlement not only involved a complicated set of compensation rules for authors, it also had sections dealing with unaddressed copyright issues like "orphan works." But Chin rejected the settlement in 2011, saying it wasn't fair. Fundamentally, it was just too big—issues like orphan works were best left to Congress, not to a class-action lawsuit.
In the long term, the failure to settle may result in more scanning, not less. If Chin's ruling stands on appeal, a clean fair-use ruling will make it easier for competitors to start businesses or projects based on scanning books—including companies that don't have the resources, legal or otherwise, that Google has.
"This has been a long road and we are absolutely delighted with today’s judgment," said a Google spokesperson. "As we have long said., Google Books is in compliance with copyright law and acts like a card catalog for the digital age, giving users the ability to find books to buy or borrow."
Authors' Guild Executive Director Paul Aiken expressed his disappointment with the ruling, saying that Google's book-scanning project is a "fundamental challenge" to copyright.
"Google made unauthorized digital editions of nearly all of the world's valuable copyright-protected literature and profits from displaying those works," said Aiken. "In our view, such mass digitization and exploitation far exceeds the bounds of the fair use defense."
The Guild is going to appeal, he added.
That means the issue will end up at the New York-based US Court of Appeal for the 2nd Circuit. That appeals court has decided several key legal battles between content and technology companies in recent years, including the Cablevision decision. That ruling legalized remote-DVR services, which has aided other tech companies, including Aereo.
Fundamentally, the fact that this case was finally decided on its merits, and not settled, is a better result for the public, argued Paul Alan Levy of Public Citizen in his reaction this morning.
"Unlike that settlement, which could have ensconced Google as the only search engine entitled to digitize books without the consent of their authors, this ruling provides a road map that allows any other entity to follow in Google’s path," said Levy.
It's judges' decisions in hard-fought cases—not overseeing secret negotiations between giants—that truly benefit the public.
"[T]he main job of a federal judge is not to supervise settlements, and especially not to bully parties into settling their cases," he wrote. "The judge’s job is to decide cases, so that every member of the public, not only the parties, can benefit from the public resources that go into the judicial system."

Does Copyright Make Books Disappear?

By Dennis Abrams

copyright
Writing for The Atlantic, Rebecca J. Rosen examined research done by Paul J. Heald at the University of Illinois and notes that “A book published during the presidency of Chester A. Arthur has a great chance of being in print today than one published during the time of Reagan.”
Rosen wrote last year about Heald’s preliminary research, and the numbers, she said, were startling. “There were as many books available from the 1910s as there were from the 2000s. The number of books from the 1850s was double the number available from the 1950s. Why? Copyright protections (which cover titles published in 1923 and after) had squashed the market for books from the middle of the 20th century, keeping those titles off shelves and out of the hands of the reading public.”
And now with his research completed, the picture remains the same. “Copyright correlates significantly with the disappearance of works rather than with their availability,” Heald wrote. “Shortly after works are created and proprietized, they tend to disappear from public view only to reappear in significantly increased numbers when they fall into the public domain and lose their owners.”
The numbers speak for themselves: There are substantially more new editions available of books from the 1910s then from the 2000s. “Editions of books that fall under copyright are available in about the same quantities as those from the first half of the 19th century. Publishers are simply not publishing copyrighted titles unless they are very recent,” says Rosen.
Heald writes, “This is not a gently sloping downward curve! Publishers seem unwilling to sell their books on Amazon for more than a few years after their initial publication. The data suggests that publishing business models make books disappear fairly shortly after their publication and long before they are scheduled to fall into the public domain. Copyright law then deters their reappearance as long as they are owned.”
In addition, Heald pointed out that research shows that while there eight times as many books published in the 1980s as in the 1880s, roughly the same number of titles from both decades are available on Amazon.
Rosen concludes by saying “Copyright advocates have long (and successfully) argued that keeping books copyrighted assures that owners can make a profit off their intellectual property, and that the profit incentive will ‘assure [the] book’s] availability and adequate distribution.” One can make the case, though, that the evidence shows otherwise.

How the Expired Copyright License of Old Literary Works Could Keep Japan’s Cultural Soil Fertile

When it comes to reading famous literary works whose copyright license has expired, there is one piece of software that is renowned for doing the job rather well. It goes by the name of “Aozora Bunko” and is a digital contents reader available on a wide variety of devices; there’s even a version available for smart phone users. It is currently host to a plethora of copyright-free material rich in Japanese history and culture. What’s particularly exciting is that the more time goes by, the more the library of works can be seen to grow.
Anyone with an interest in old Japanese masterpieces – and can read Japanese – will surely be lured in by what this software has to offer. In this connection, on January 1 this year, the legendary writer Eiji Yoshikawa’s work “Miyamoto Musashi” is also set to be added to the collection. Miyamoto Musashi is a bestselling novel depicting the life of legendary samurai Musashi Miyamoto, who actually existed during the Japanese Edo era.
Just what makes all this free content possible is the rule that governs copyright licensing laws: 50 years after an author has passed away, copyrighted works are released freely into the public domain.

This year sees the author Kunio Yanagita’s work ”Tono Monogatari”( in English, The Legends of Tono) also made available. “Tono Monogatari” is a collection of folklore stories and legends passed down from generations of old in the Tono region of Japan.

Next year, the work “Zenigata Heiji Torimono Hikae”, written by Kodo Nomura, gets released. This is a famous period novel whose setting is fixed in the Edo era and depicts the fictitious detective Zenigata Heiji as he goes about capturing criminals. It has even been adapted into a TV period drama.

Some may be thinking, “Well, I’m not that much of a reader in the first place. This whole copyright issue doesn’t really affect me.” However, the expiration of the copyright license has implications in other areas as well. Fukui, a specialist in Copyright law explains:
“Once the copyright license expires, fundamentally speaking, anyone can make use of the work as they please. An example of this would be the Japanese version of ‘The Little Prince`, known as `Hoshi no Ouji sama` in Japanese. This title’s copyright license expired in 2005 and subsequently saw a number of Japanese publishing companies releasing new translations. This actually served to revive the work and create quite a boom, which in turn secured a new fan base. What’s more, not having to pay a copyright fee means that a piece of work is much easier to adapt into a play or film format. ”
Fukui believes that the birth of derivative or secondary works is crucial in resurrecting past literature and preventing it from fading into the unknown. When a new character or story related to the original work comes into existence, everything takes on a whole new perspective and helps to spark the interest of the modern audience.

▼Ginga tetsudo no yoru

“When a piece of literature is still under the jurisdiction of the copyright license, it is considerably difficult to adapt, or deviate from the original work. There’s a famous anecdote that demonstrates this well: The masterpiece animation `Ginga tetsudo no yoru`(‘The Night of the Milky Way Train’ in English) is famous for its protagonist being a cat but it is rumored that whilst the novel’s copyright license was still valid, turning the protagonist from a human (original work) in to a cat (derivative work) just wasn’t possible. Of course there will always be some element of restriction, but once the copyright license expires, it’s possible to experiment much more freely with the original material.”
To give you a bit more of an understanding of this, the above mentioned Yoshikawa’s work “Miyamoto Musashi” has already been adapted into a comic and a period TV drama, but from here on, it is predicted that with the end of the copyright license, a new era of derived works will begin to make their way on to the market.
The expiration of a copyright license can often mean the birth of a new literary work and add to the richness of a culture as a whole. “This is one of the important reasons behind the copyright limit itself.”
What’s also important here is that any secondary works are then also accompanied by their own copyright license. For example, it’s quite possible that if a new piece of work based on Tono Monogatari were to be exported onto the international market, it could become a big hit and create considerable earnings.
“Cool Japan’s literary works have real potential in projecting the country further on the international scale. A large amount of content whose copyright has expired often portrays the older, more fascinating aspects of Japanese culture and history. I have great hope that these works will increase recognition of Japan’s literary world on a grand scale.” admits Fukui.

ACTA=Εμπορική Συμφωνία κατά της Παραποίησης

Πώς λειτουργεί;
Είναι όντος εμπορική συμφωνία;
Ποιοι στηρίζουν την ACTA;
Εταιρικά λόμπυ όπως η Glaxo Smith Kline, Pfizer, Sanofi-Aventis, Mosanto, η Time Warner, η Sony Verizon, The Walt Disney Company, η Motion Picture Association of America, η News Corporation και η Viacom.
Ποιοι εναντιώνονται;

To group Dead Kennedys
